The U.S. Court of Appeals Ruling on Ozone and Particulate Matter: What Does It Mean for the Future of Regulation?

In a 2-1 ruling, a U.S. Circuit Court of Appeals panel in Washington ruled that the Environmental Protection Agency's rationale for setting the ozone and particulate matter standards under the Clean Air Act represents an unconstitutional delegation of legislative authority. That decision could have enormous implications for regulation and the delegation of powers to federal agencies. The Joint Center has convened a panel of experts to interpret the meaning of the decision.
