Intellectual Property Law: A New Perspective

Intellectual property rights have undergone a significant expansion that began with the Copyright Act of 1976. Judge Richard Posner will discuss intellectual property law and present a new theory to explain why it is expanding. He will argue that public choice––wherein individuals, interest groups, and politicians pursue their own self interest when making decisions––is helpful in explaining the expansion of intellectual property rights. However, a complete explanation must include other key factors, including political and ideological beliefs and the institutional characteristics of courts and legislatures.
